Life Insurance Claims

Although most life insurance claims are paid without any dispute, there are instances which arise that result in the wrongful denial of a life insurance claim by the insurance company.

Some Reasons for Denial:

Some of the instances which result in the denial of a life insurance claim are as follows:

  1. Failure of the insured to disclose an adverse medical history within the life insurance application which results in a material misrepresentation.
  2. The suicide of an insured, while sane or insane, within two years from the date of issue of the life insurance policy.
  3. The lapse of the life insurance policy for unpaid premiums.

Although the three instances above may appear to be a solid basis for denial of a claim, there may also be proper legal actions in response to the denial. For instance, what constitutes a material misrepresentation? Was the insured’s death really a suicide or a merely an accident? Maybe the premiums were not paid because the insured was terminally ill and not physically able to make the payments?

We can not identify every factor or reason which may result in the denial of a life insurance claim. Additionally, not every life insurance claim denied by the insurance company is improper. If you believe that a life insurance claim has been wrongfully denied, we suggest that you contact our office immediately with your questions or concerns.

If you and/or a family member believe that an insurance company has wrongfully denied life insurance benefits, then you and/or the family member may be eligible to file a claim. However, persons seeking to preserve any potential legal claims should contact an attorney promptly because Texas has mandatory time periods ("Statute of Limitations") in which a lawsuit must be filed.
